Thank you for selecting the Services offered by Digigarage Technologies Pvt. Ltd. (“AZORE”) and/or its subsidiaries and affiliates (referred to as "AZORE", "we", "our", or "us") provided to you on this website and/or mobile apps, including content, updates and new releases, (collectively, the "Services"). Review these Terms of Service ("Agreement") thoroughly. By accepting electronically (for example, clicking "I Agree" or "Login"), installing, accessing or using the Services, you agree to these terms. If you do not agree to this Agreement, then you may not use the Services.

The below terms of service is applicable to all Users of AZORE, which includes the Residents, Management Committee, Office Staff and all other users using the Portal.
DEFINITIONS:
REGISTRATION:
In order to use this Portal, a User must first complete the registration form. During registration a User is required to provide his/her contact information and proof of being associated with the dwelling/commercial unit/s (residence). The registration information given by the user shall always be accurate, correct and up to date. This ensures the User can get the maximum benefit from the Portal.
SUBSCRIPTION:
AZORE is licenced on a periodic subscription basis, as selected by you or your organization.
PERSONAL INFORMATION:
The User provides information about himself/herself under the User profile. Information provided is available to the User and the Administrative Users of the Complex. The Visitor information entered in the portal is available to the flat to which the visitor is visiting, and to the Administrative Users belonging to the same Multi Dwelling/Commercial Unit as the user.
You can view AZORE Privacy Policy provided with the Services and on the website for the Services. You agree to the applicable AZORE Privacy Policy, and any changes published by AZORE. You agree that AZORE may use and maintain your data according to the AZORE Privacy Policy, as part of the Services. You give AZORE permission to combine information you enter or upload for the Services with that of other users of the Services and/or other AZORE services. For example, this means that AZORE may use your and other users' non-identifiable, aggregated data to improve the Services or to design promotions.
You acknowledge and agree that in order to provide you access to and use of the AZORE Services, AZORE may provide your access information and account data to (i) your managing committee or facility management agency or organization who is identified in the registration data as the current system administrator for your account (the "Current Administrator"), and (ii) such other committee member or employee or agent who may be designated by you as a replacement administrator for the your account by following the procedures required by AZORE to effectuate such replacement. Any other person You identified as an authorized user of the AZORE Services will have access to the account data subject to the access permissions you or the system administrator assigned to them.
USER ACCOUNT, PASSWORD AND SECURITY:
You are responsible for maintaining the confidentiality of the UserID and password you choose when you create your account, and are fully responsible for all activities that occur under your account. You agree to immediately notify AZORE of any unauthorized use of your password. AZORE will not be liable for any consequence arising from your failure to comply with this Section.
CONTENT AND ABUSE OF SERVICE:
You are responsible for all materials ("Content") uploaded, posted or stored through your use of the Services. You grant AZORE a worldwide, royalty-free, non-exclusive license to host and use any Content provided to offer you the Services. AZORE is not responsible for the Content or data you submit through the Services. You agree not to use, nor permit any third party to use, the Services to upload, post, distribute, link to, publish, reproduce, engage in or transmit any of the following, including but not limited to Illegal, fraudulent, defamatory, obscene, pornographic, irreverent, threatening, abusive, hateful, harassing, offensive, inappropriate or objectionable information or communications of any kind, including without limitation conduct that would encourage "flaming" others, or criminal or civil liability under any law;
The Services may include community forums or other social features to exchange Content and information with other users of the Services and the public. AZORE does not support and is not responsible for the content in these community forums. Please use respect when you interact with other users. Do not reveal information that you do not want to make public. Users may post hypertext links to content of third parties for which AZORE is not responsible.
AZORE may, but has no obligation to, monitor content on the Services. We may disclose any information necessary to satisfy our legal obligations, protect AZORE or its customers, or operate the Services properly. AZORE, in its sole discretion, may refuse to post, remove, or refuse to remove, any Content, in whole or in part, alleged to be unacceptable, undesirable, inappropriate, or in violation of this Agreement.
AZORE may freely use feedback you provide. You agree that AZORE may use your feedback, suggestions, or ideas in any way, including in future modifications of the Services, other products or services, advertising or marketing materials. You grant AZORE a perpetual, worldwide, fully transferable, sub-licensable, non-revocable, fully paid-up, royalty free license to use the feedback you provide to AZORE in any manner.
USE WITH MOBILE DEVICE:
Use of these Services may be available through a compatible mobile device using Internet access and may require application. You agree that you are solely responsible for these requirements, including any applicable changes, updates and fees for SMS messages, data plans, and general usage, as well as the terms of your agreement with your mobile device and telecommunications provider. AZORE makes no warranties or representations of any kind, express, statutory or implied as to:

AZORE Services may include links to third party websites including nearby vendors that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites and links and service provided by such vendors. Moreover, you acknowledge and agree that AZORE shall not have any liability and shall not make responsible for any transaction/conduct/breach between you and any third party or nearby vendors listed on the portal. AZORE shall not be responsible for any breach of conduct and service by nearby vendors..
NO RESALE OF SERVICE:
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the service, use of the Service, or access to the Service.
PROPRIETARY RIGHTS:
You acknowledge and agree that the Portal contains proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by AZORE, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service, in whole or in part. You also agree not to extract the code or reverse-engineer it in anyway. Any attempt at hacking or unlawful use of AZORE will invite the prosecution allowable under the law.
LIST OF PROHIBITED ITEMS:
On AZORE, users are prohibited from aiding in the sale / exchange of any item present in the below list. This is only a partial list and may be amended as and when prohibited by law or brought to the notice of AZORE:
Airline tickets that restrict transfer, other unauthorized ticket sale - Alcohol or tobacco products - Blood, bodily fluids or parts - Bulk email or mailing lists that contain names, addresses, phone numbers, or other personal identifying info Burglary tools, including but not limited to lock-picks or motor vehicle keys - Controlled substances or illegal drugs, substances and items used to manufacture controlled substances and drug paraphernalia -Counterfeit currency, coins and stamps, tickets, as well as equipment designed to make them - Counterfeit, replica, or knock-off brand name goods - Coupons or gift cards that restrict transfer, other unauthorized coupons or gift cards - False identification cards, forged certificates - Fireworks, firearms and explosives - Gambling items, including but not limited to lottery tickets - Material that infringes copyright, including but not limited to software or other unauthorized digital goods sale - Pornography - Pet animal parts, blood, or fluids - Prescription drugs and medical devices, including but not limited to prescription or contact lenses, defibrillators, hypodermic needles or hearing aids - Stolen property, or property with serial number removed or altered.
SECURITY:
AZORE takes every precaution to protect Users' information. When Users submit sensitive information on the portal, the information is protected both online and off-line. We have enabled SSL encryption so as to ensure that your data remains encrypted during transmission to and from the site. These precautions, though industry standard are nonetheless only as secure as the end-user's practice. To ensure that unauthorised parties do not get access to information on this portal, we encourage all users make sure that they log-off from all sessions - especially from public computers such as at internet cafes.
As part of our disaster recovery strategy, we have regular backups taken to protect you from sudden data loss. If you have any questions about the security at our portal, you can send an email to support@azore.in.
WEBSITE AND SERVICE UPDATES:
We also send the User website and service announcement updates. Users may choose to unsubscribe from receiving these emails by following the instructions that will be part of each announcement email.
NOTIFICATION OF CHANGES:
Any change made to the Privacy Policy will be posted on the Homepage so our users are always kept aware. Also they will be notified via Email about any such change.
BETA FEATURES:
From time to time, AZORE may, at its sole discretion, include new and/or updated beta features ("Beta Features") in the AZORE Services for your use and which permit you to provide feedback. You understand and agree that your use of the Beta Features is voluntary and AZORE is not obligated to provide you with any Beta Features. You understand that once you use the Beta Features, you may be unable to revert back to the earlier non-beta version of the same or similar feature. Additionally, if such reversion is possible, you may not be able to return or restore data created within the Beta Feature back to the earlier non-beta version. The Beta Features are provided on an "as is" basis and may contain errors or inaccuracies that could cause failures, corruption or loss of data and/or information from any connected device. You acknowledge and agree that all use of the Beta Features is at your sole risk.
ADDITIONAL TERMS:
You will manage your passwords and accept updates. You are responsible for securely managing your password(s) for the Services and to contact AZORE if you become aware of any unauthorized access to your account. The Services may periodically be updated with tools, utilities, improvements, third party applications, or general updates to improve the Services. You agree to receive these updates.
DISCLAIMERS:
The Service is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to
LIMITATION OF LIABILITY AND INDEMNITY:
In no event shall either party’s aggregate liability arising out of or related to these Terms/Agreement, whether in contract, tort or under any other theory of liability, exceed the total amount paid by you under the current active Premium Agreement. Subject to applicable law, AZORE, its affiliates, employees, directors and suppliers are not liable for any of the following. (a) indirect, special, incidental, punitive or consequential damages; (b) damages relating to failures of telecommunications, the internet, electronic communications, human errors, corruption, security, loss or theft of data, viruses, spyware, loss of business, revenue, profits or investment, or use of software. The above limitations apply even if AZORE and its affiliates and suppliers have been advised of the possibility of such damages. This agreement sets forth the entire liability of AZORE, its affiliates and your exclusive remedy with respect to the services and its use.
You agree to indemnify and hold AZORE and its Affiliates and Suppliers harmless from any and all claims, liability and expenses, including reasonable attorneys' fees and costs, arising out of your use of the Services or breach of this Agreement (collectively referred to as "Claims"). AZORE reserves the right, in its sole discretion and at its own expense, to assume the exclusive protection and control of any Claims. You agree to reasonably cooperate as requested by AZORE in the defence of any Claims.
TERMINATION:
AZORE may immediately, in its sole discretion and without notice terminate this Agreement or suspend the Services if you fail to comply with this Agreement or if you have not made payment against the invoices that are due. Upon termination you must immediately stop using the Services and any outstanding payments will become due. Any termination of this Agreement shall not affect AZORE's rights to any payments due to it. AZORE may terminate a free account at any time. This agreement will survive and remain in effect even if the Agreement is terminated.
SEVERANCE:
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
